Faith, character, judicial orientation, or judicial temperament concerns characterize challenges that Justices Louis Dembitz Brandeis, Clarence Thomas, Ruth Bader Ginsburg, Brett M. Kavanaugh, Amy Coney Barrett and Justice-Designate Ketanji Brown Jackson each and all encountered in United States Senate evaluations of their elevations as Associate Justices of the United States Supreme Court during Senate Judiciary Committee hearings.
Louis D. Brandeis’s nomination and Senate confirmation created a fresh way to evaluate Supreme Court appointments. In 1916, the extent of testimony, range of investigation, many instances in which Senate Judiciary Committee hearing morphed to trial, voluminous commentary and intense newsworthiness are all new.
Strategizing, influencing and securing senate votes and inflecting public opinion in the name of the public interest for nominee, senate, president, party and professional and career self-interest would emerge as standards. Nominees seek Senate votes and strive to inflect public opinion. Senators cultivate colleagues and constituents. Partisans advertise real and purported influence and promote fundraising. News organizations compete to increase circulation and audiences.
While religious bigotry colors all their nominations, but for Ginsburg’s and Jackson’s, each’s distinct disruption to historic belief systems and incumbent elites and their business models raises concerns about their elevations.
For Brandeis, an industrial monopolist he counselled to create and flourish and the president of a historic educational institution benefitting from a bequest of stock from one of that firm’s founders vehemently oppose his elevation as Associate Justice.
For Thomas, a fresh middle class of African-American political and professional elites and autonomy advocates seek to thwart his elevation due to his intellectual independence and originalist and textualist jurisprudence.
For Ginsburg, any institution practicing discrimination on the basis of sex would have to reckon with her policy preferences.
For Kavanaugh and Coney Barrett, like Thomas before them, Progressive public policy proponents and autonomy advocates viewed originalism and textualism as death kisses. Silicon Valley seemed distinctly anxious about Kavanaugh, but how much was Senator Grassley enriches.
Jackson raised concerns about public order due to lenient federal incarcerations standards and decisions.
All the Justices’ adversaries are defensive. Each incumbent elite steadfastly persists protecting its position. It matters little whether they are storied and well capitalized, like Harvard University President A. Lawrence Lowell and the United Shoe Machinery Corporation opposing Brandeis, or fresh African American middle class professionals averse to Thomas and championing Jackson or early 21st century autonomy elites opposing Kavanaugh and Coney Barrett.
Due to their defensiveness, all incumbent elites invariably become shrill. High pitched piercing denunciations afflict Kavanaugh in 2018. What was thought of as extreme in 1916 when Brandeis’ adversaries engineered a front page New York Times news report detailing their opposition morphed to politicized activations of living theater and performance art as a chapter reporting a leaked, initial draft in Dobbs potentially overturning Roe and Casey, in May, 2021 reports.
When adversaries are defensive, religious bigotry has an easier time recrudescing. From the onset, nominee adversaries are fighting to protect capital accumulation and ways of living they esteem. To them, each nomination is an attack. Whatever Brandeis might have said about secular Judaism or Thomas, Kavanaugh or Coney Barrett might say about Roman Catholicism, or Jackson about nondenominational Protestantism is incidental. Inexorable adversaries evince no tolerance for conciliation.
It is an arresting propinquity that Progressive public policy and autonomy advocates shredded Brandeis’s privacy concerns when it came to Thomas and Kavanaugh and embrace and extend Brandeis’ privacy insights regarding torts to constitutional law.
In these ways, their nominations illuminate contemporaneous capital accumulation, production, consumption and journalism.

Alleging shame is easier than proving guilt.
Partisan informant is a more accurate characterization than whistleblower. An individual, who witnesses a wrong-doing and comes forward to enable a system to self-correct, is a whistleblower.
The informant was not a witness and remained anonymous.
President Trump is correcting a corrupt system, many believe.
Due to these infirmities, impeachment suffered fatal flaws (no eye witness; two participants, Ukraine President Volodymyr Zelensky and Foreign Minister Vadym Prystiako, confirming President Trump’s account; informant anonymity beclouding authenticity; substitution of hearsay and supposition for evidence; forestallment of judiciary branch evaluation of the President’s executive authority claims; unauthorized subpoenas, articles inflating policy disagreements between the president and advisors as abuse of power (article 1) and legislative branch authority (article 2).
Partisan impeachment triggers electoral risks for Democrats. ERASE IMPEACHMENT could emerge as campaign rhetoric to flip 30 or so House districts that elected Democrats in 2018 and voted for President Trump in 2016 by appealing to voters offended by its unfairness.
The bitter reality that House impeachment potentially terminates President Trump’s pardons could mobilize African American voters for the president. Either by stealth or unwittingly, House Democrats may have curtailed President Trump’s pardons and reprieves. Article II Section 2 of the Constitution suggests no less: “The President… shall have Power to grant Reprieves and Pardons for Offences against the United States, except in Cases of Impeachment.” Under the First Step Act, President Trump pardons a number of African-Americans, who were convicted of non-violent narcotics violations or the 1994 Crime Act authored by then Senator Joe Biden and championed by President Bill Clinton. Virtually all rehabilitate themselves, invariably through religious devotion, affiliation and fellowship, during incarceration. “ERASE IMPEACHMENT. President Trump sets us free” peals a liberty bell of freedom for African Americans.
Erasing impeachment could be the initial act of a majority Republican Congress.
There’s precedent. In 1837, the Senate expunged an 1834 censure of President Andrew Jackson for exceeding constitutionally delegated authority governing banking.
President Trump identifies with President Jackson. Erasing impeachment would give contemporaneous expression to “the people’s president.”
Like so much with President Trump, this is all new and historic.

The vague provenance and partisan shortcomings of House decision-making animated abuses of procedures and rules fating failure.
But, in the end, those were incidental. What mattered was an attempt to reorient public attention to the Democrat Party as one of rules, procedures and order to replace all the attention lavished on Progressive newcomers.
And, what mattered was tarnishing and diminishing President Trump to lure swing voters in the 2020 presidential election.
Nancy Pelosi employs impeachment to sway middle class, suburban women with rhetoric celebrating the moral authority of mothers raising children.
Adam Schiff triumphs as a new Nixon.
House Democrats insinuated parliamentary government and diminished the presidential system by blowing up a policy dispute among the president and his advisers to a constitutional crisis.
By branding the president with impeachment, shame powered relevance, the internal combustion engine of the contemporaneous Internet.
Impeachment was great constituent service, one could postulate. Nancy Pelosi represents San Francisco, the center of finance capital for networked communications, social media and information innovation. Adam Schiff represents Hollywood, the center for entertainment industries producing content for theater, broadcast, cable and wireline and wireless distributed networks. Jerrold Nadler represents the Financial District, West Side Manhattan, centers of investment, publishing, broadcasting, creative content and marketing. Their districts are home to some of the wealthiest individuals and enterprises, the 1%, whose wealth accumulates and derives from relevance.

In prize fighting, a slogger inflicts heavy blows repeatedly, forcefully, indefatigably pounding adversaries.
SLOGGER examines President Trump’s announcement and campaign for the presidency, inauguration and his first 100 days in office, Charlottesville and its ensuing controversy, the firing of James B. PRECURSE analyzes the Brett Kavanaugh and Clarence Thomas hearings for nomination to the Supreme Court.
Anita Hill came forward in 1991 after Thomas's nomination hearings had concluded with memory of alleged sexual harassment that had transpired, she asserted, eight on nine years earlier.
In 2018, after Judiciary Committee hearings evaluating Judge Kavanaugh had concluded but for voting, Christine Blasey Ford came forward with an impugning memory of alleged attempted groping and disrobing attributed to teen-aged Brett Kavanaugh by allegedly placing his hand over her mouth thirty six years earlier in the alleged encounter.
The accusation created an obligation for the Senate Judiciary Committee and the Senate to adhere to its constitutional obligations to advise and consent on judicial appointments in an unprecedented evaluation of an accusation based on uncorroborated memory as a determining factor of a nominee’s elevation to Associate Justice of the Supreme Court.
If the allegation were an inaccurate recollection or a confabulation, Senate evaluation tested whether an inculpating, uncorroborated memory could be more damning than unalloyed truth or exculpating denial, for authenticating the veracity of allegation or denial fell beyond standards of investigation for determinations of guilt yet animated pervasive opportunities for imputations of shame.
Whatever the veracity, it was a cunning gambit. The accusation shifted the burden of proof of innocence or guilt in connection with alleged criminal conduct to a public relations trial imputing shame well after Judge Kavanaugh had address Judiciary Committee concerns.
In this political test, Kavanaugh found that he had to reclaim his integrity, demonstrate his temperament, prove his suitability and vindicate his political palatability in the court of public opinion yet again addressing Blasey Ford’s sullying allegation.
The allegation played out as a fruitless, delaying tactic by adversaries of Judge Kavanaugh, typified a recrudescence of Know-Nothings, the ante-bellum intolerance of Roman Catholics, in Supreme Court nomination and confirmation as a contemporaneous correlative to the anti-Semitism that Justice Louis D. Brandeis foresuffered more than one hundred years ago.
PRECURSE presents analysis of Judge Brett Kavanaugh’s textualist jurisprudence and observes women’s empowerment.
The Internet embodied a crucial difference between the Thomas spectacle and the Kavanaugh spectacle. The earlier spectacle was substantially in the newspapers and on television and radio mediated by journalists and editors.
The Kavanaugh spectacle transpired over broadband wireline and wireless networks and fixed and mobile communications devices and displays mediated by anyone who wished to participate.
In both instances, the spectacles represent significant revenue generation opportunities for dominant firms across networking, social media and journalism.
Pornography and obscenity emerge as particularly serviceable vehicles for the Hill accusations and for Kavanaugh allegations.
For all the ultimately gratuitous sullying, the Blasey Ford accusations advanced the public interest by enabling citizens to evaluate the integrity of the Justice and the provenance and stengths and weakesses of the besmirching allegations.
If, however, Judge Kavanaugh’s nomination had collapsed due to being “credibly accused” of conduct without authenticating the veracity of accusations in absences of any corroborating testimony or evidence, coming forward with uncorroborated memory, complemented by other unverifiable memories or baseless accusations, that failure would have undermined the public interest by encouraging meritless allegations vitiating the presumption of guilt, due process and governance.
But, those concerns were incidental. Shame trumped guilt.
Senator Diane Feinstein’s deft politics helped her defeat a dynamic, young Progressive challenger by attracting votes of older women.
The spectacle made for impelling television and boosted business volumes for California interactive computer service and communications oligopolies, Alphabet/Google, Apple, Facebook, Twitter.
The spectacle merits evaluation as a skirmish in ongoing campaigns of empowerment, misandry and religious intolerance contesting Supreme Court appointments.

ANOMALIES CORNERSTONE THE 2016 PRESIDENTIAL ELECTION, NOTABLY:
Hillary Clinton’s
1.) candidacy as the first female presidential nominee of a major political party,
2.) efforts to control information, principally a private archive of public records while serving as Secretary of State from 2009 to 2013, which sustained her reputation going yet undid her election,
3.) scandalous faith, quiz show grace and mainline, Protestant Progressive politics making and undoing her candidacy,
4.) Donald Trump’s hostile takeover of the Republican Party assailing Clinton’s Progressive politics, attacking her involvement with Benghazi and private archive of public records characterizing her as a corrupt, incompetent practitioner of a rigged system,
5.) Congressional Republican production and news organization publication of political pornography and fake news in connection with Benghazi in 2015,
